Our Process

1. Initial Consultation & Case Evaluation

The first step to any personal injury case is to determine whether the case has merit. Personal injury cases are generally taken on contingency. Except under unique circumstances, no fee will be charged until the case has been completely resolved. This means that the firm will not take a fee unless you win your case!

2. Determine Extent of Damages & Appropriate Course of Action

Second, your case will be evaluated to determine the extent of the injuries and/or property damage. This information will guide the plan of action going forward.

3. Remedy Damage & Begin Treatment

Third, begin repair of the property damage and start treatment for the injuries, if treatment has not already begun.

4. Finish Treatment

Ensure that all property damage has been repaired. Make sure that the medical injuries have been completely treated, and plan for future medical treatments as necessary.

5. Enter Settlement or File Lawsuit

The majority of personal injury cases will reach a settlement prior to filing a lawsuit. If a settlement is not offered or accepted, a lawsuit will be filed.

Do I owe any payment up front?

No. We do not receive ANY payment unless we win your case.

What if I don’t have insurance?

Car Insurance

This does not automatically disqualify you from moving forward with your case or obtaining treatment. If the person at fault in the accident has car insurance, you may still be able to file an insurance claim.

Medical Insurance

Lack of Medical Insurance does not automatically disqualify you from moving forward with medical treatment. Certain medical providers may still be willing to treat you on a lien, contingent on paying them back out of the settlement proceeds of your case.

What are the fees?

The firm will not charge a fee until we have won your case.

Generally speaking, most personal injury claims will end with a settlement. When this is the case, the firm will charge 33.3% or 1/3 of the total settlement.

If a lawsuit is filed and the case goes to trial, the firm will charge 40% of the total settlement plus a negotiable hourly rate for services provided after filing the lawsuit. Remember, even if the hourly rate kicks in, there will not be any payments due until your case is won. All payments are typically paid out of the proceeds of the case.

How long will my case take to get resolved?

There is no clear cut answer to this question. This largely depends on the seriousness of the injuries, and the extent of the damages involved. Generally speaking, personal injury cases can take several months or even years depending on how complex the case is. Regardless of how long it takes for a case to be resolved, you will not pay anything until your case is won.
